The Board is established under the provision of the Optical Dispensers Act 1963. This legislation has remained largely unchanged since its inception. The Optical Dispensers (Amendment) Act 1987 was never proclaimed and the Board has made recommendations to the Minister for Health at various stages for changes to the Act.

The Optical Dispensers Regulation is reviewed every five years.  The last review was undertaken in 2007.
